USER AGREEMENT

1. General Provisions

1.1 This User Agreement (hereafter "Agreement") is a legally binding agreement between you (hereafter "User") and [name of site owner] (hereafter "Site Owner").

1.2 Agreement regulates the relationship between the User and the Site Owner regarding the User's use of the website located at [https://www.flo.com.kz/] (hereafter referred to as the "Site").

1.3 By using the Site, the User unconditionally accepts all provisions of this Agreement.

1.4 User undertakes not to infringe the rights of other users, including intellectual property rights, when using the Site.

1.5. The site owner reserves the right to change or temporarily suspend the conditions for providing access to the site at any time without prior notice.

2. Details Regarding the Site

2.1 Site is the online store, where the User may know the range of products offered, select and purchase products.

2.2 Site Owner is entitled to make changes on the content of the Site, product range, product prices and this Agreement at any time.

3. Registration in the Site

3.1 In order to place an order on the site, you may register by creating a User Account.

3.2 User undertakes to enter accurate and up-to-date information about himself/herself during the registration.

3.3 User is responsible for the security of his/her password and may not disclose his/her password to the third parties.

4. Intellectual Property

4.1 Site and the intellectual property objects located on the Site, such as: Trademarks, service marks, trade names, other means of personalization of participants of civil circulation, materials, design, author's content, photographs, as well as other objects of intellectual property belonging to the Site Owner, group of companies and affiliates or licensors of the Site Owner and other right holders are protected by the legislation of the Republic of Kazakhstan and certified international treaties on the protection of intellectual property.

5. Creating an Order

5.1 User independently places an order through the Site.

5.2 When creating an order, the User undertakes to enter accurate and up-to-date information about himself / herself, which is necessary for the delivery of the products.

5.3 Site Owner is entitled to refuse the creation of an order by the User without explaining the reasons.

6. Delivery and Payment of the Products

6.1 Delivery of the Products is carried out by the methods specified on the Site.

6.2 Payment for products is made by the methods specified in the Site.

6.3 User is responsible for the accuracy of the data, which are provided by him/her and are necessary for the delivery and payment of the products.

7. Return of the Product

7.1 Return of the products of appropriate quality is carried out in accordance with the Law of the Republic of Kazakhstan "On Protection of Consumer Rights" and the contract on the sale of products via the Internet.

7.2 Return of the products of poor quality is carried out in accordance with the Law of the Republic of Kazakhstan "On Protection of Consumer Rights" and the contract on the sale of products via the Internet.

8. Rights and Liabilities of the User

8.1 User has the following rights:

• To obtain information about the products offered in the Site;
• To place an order through the Site;
• To use the Site in accordance with this Agreement.

8.2 User undertakes the following matters:

• Not to use the Site for illegal purposes;
• Not to use the Site to publish defamatory, libelous, obscene or other information that may harm the Site Owner or third parties;
• Not to use the Site for the distribution of spam;
• Not to use the Site to download files containing viruses or other malicious programs.

9. Rights and Liabilities of the Site Owner

9.1 Site Owner has the following rights:

• To make changes to the Site content, product range, product prices and this Agreement at any time;
• If the User provides incorrect registration information or if the Site Owner has grounds to believe that the registration information entered is inaccurate, incomplete, incorrect, violates the terms of this Agreement, or that the person has used someone else's information, the Site Owner has the right to suspend or cancel the User's registration and/or delete the User.
• To use the information provided by the User in accordance with the Privacy Policy.

9.2 Site Owner undertakes the following matters:

• To ensure the uninterrupted operation of the Site;
• To process User orders in accordance with this Agreement;
• To provide the User with information about the products offered on the Site.

10. Liability

10.1 Site Owner is not responsible, does not indemnify and shall not be held liable for any damages, including lost profits, moral and other damages, caused to the User or third parties as a result of their use of the Site or in connection with the operation of the Site and in all other cases provided for in this Agreement.

10.2 Site Owner is not responsible for any agreements made between Users or between Users and third parties in connection with the use of the Site.

10.3 User is responsible for any damage caused to the Site Owner as a result of using the Site in violation of the terms of this Agreement.

11. Dispute Settlement

11.1 All disputes arising between the User and the Site Owner are resolved through negotiations.

11.2 In case the disputes are not resolved through negotiations, they shall be resolved in the competent courts of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan.

12. Validity Period of the Agreement

12.1 Agreement enters into force from the moment this offer is accepted by the User.

12.2 Agreement is an offer in accordance with 395th Article of the Civil Code of the Republic of Kazakhstan, and, therefore, the Site Owner is entitled to withdraw from the Agreement in accordance with 404th Article of the Civil Code of the Republic of Kazakhstan. In case of cancellation of the Agreement by the Site Owner during the validity period of the Agreement, the Agreement is considered to be terminated from the moment of cancellation. Cancellation is carried out by posting the relevant information on the Site.

12.3 Agreement has been concluded for an indefinite period.

12.4 This Agreement shall apply to Users who have registered prior to the date when this Agreement is posted on the Site.
